This Disclaimer applies to your use of Amboi.my (the "Platform"), operated by AMBOI MY SDN. BHD. ([SSM Registration No.]). It supplements — and should be read together with — our Terms & Conditions, Privacy Policy, and Vendor Agreement.
Where this Disclaimer conflicts with the Terms & Conditions, the Terms & Conditions prevail. By using the Platform you confirm that you have read, understood, and accept this Disclaimer.
1. Marketplace Role — We Are an Intermediary
- Amboi.my is an online marketplace that connects Customers planning events with independent Vendors who supply event services. We do not manufacture, prepare, deliver, or perform any service ourselves.
- All bookings are direct contracts between the Customer and the Vendor. Amboi.my is not a party to those contracts, even though we facilitate the matching, payment, and dispute-resolution surfaces.
- We do not act as agent, broker, employer, partner, or fiduciary of either the Customer or the Vendor in connection with any booking.
2. No Warranty of Quality, Fitness, or Availability
To the maximum extent permitted by Malaysian law:
- The Platform and its content are provided on an "as is" and "as available" basis. We make no warranty — express, implied, statutory, or otherwise — about the quality, accuracy, safety, fitness for a particular purpose, legality, or non-infringement of any Vendor listing or service.
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses, and we may suspend access for maintenance, upgrades, or security reasons without notice.
- Search results, "best match" rankings, featured placements, and recommendations are algorithmic and editorial signals — not endorsements. We do not guarantee that any ranked Vendor is the best, cheapest, fastest, or most suitable choice for your specific event.
- Nothing in this section limits any non-excludable consumer right under the Consumer Protection Act 1999 or any other Malaysian law.
3. Vendor Listings — Accuracy Is the Vendor's Responsibility
- Vendor listings — including service titles, descriptions, photos, packages, pricing, addons, capacity, working hours, and lead times — are provided by Vendors. Amboi.my reviews submissions for admissibility, but does not independently verify every claim.
- Photos and videos uploaded by Vendors represent past work; they are not a guarantee of identical results for your event.
- Prices shown may exclude addons, travel fees, peak-date surcharges, and applicable taxes (including SST). The final price quoted at the booking confirmation step is the binding price for that booking.
- If you spot a listing that is inaccurate, misleading, or outdated, please report it via the in-platform reporting tools or email contact@amboi.my.
4. Halal, Dietary, and Religious Claims
- Where a Vendor lists a service as "Halal", "Halal-certified", "Muslim-friendly", "alcohol-free", or makes equivalent dietary or religious claims, those claims are the Vendor's own representation. Vendors are contractually required to hold and maintain the relevant certification (JAKIM, state Islamic authority, or other recognised body) but Amboi.my does not independently audit certificates and does not guarantee their continued validity.
- Customers with strict dietary, religious, or allergen requirements must confirm Halal or other certification directly with the Vendor before booking. Halal "auto-hide" filters and chip filters on the Platform are a discovery aid only.
- Amboi.my is not liable for any loss, distress, or harm arising from a Vendor's misrepresentation of Halal, dietary, or religious status. Misrepresentation is grounds for immediate vendor suspension and is treated as a serious dispute under the Vendor Agreement.
5. Food Safety, Allergens, and Physical Risk
- Vendors supplying food, beverages, transport, fireworks, pyrotechnics, hair/makeup, body-art, photography drones, or any other physical service remain solely responsible for their own health, safety, hygiene, and licensing compliance under Malaysian law.
- Customers must inform the Vendor of any allergies, intolerances, accessibility needs, or special requirements at the inquiry or booking step. Amboi.my does not forward these to Vendors automatically.
- Activities involving inherent risk — including but not limited to outdoor events, water activities, transport, food service, and fireworks — are undertaken at the Customer's and their guests' own risk. Amboi.my is not the operator of these activities and is not liable for personal injury, property damage, or loss arising from them, except to the extent caused directly by our own negligence.
6. User-Generated Content, Reviews, and Stories
- Reviews, ratings, peer-vendor feedback, Stories posts, comments, and other user-generated content represent the personal opinions of the contributing user. They do not represent the views, recommendations, or endorsements of Amboi.my.
- We moderate content for compliance with our Acceptable Use Policy but do not pre-screen every submission. Content that breaches our policies may be flagged, hidden, or removed.
- Vendors and Customers may flag reviews they believe are inaccurate, defamatory, or retaliatory through the in-platform flag tool. Decisions on flagged content are made at our reasonable discretion and are final.
- You retain ownership of the content you post and grant Amboi.my the licence described in our Terms & Conditions to host, display, and promote it on the Platform.
7. Third-Party Services, Links, and Integrations
- The Platform integrates with third-party services for payments (Stripe, Billplz, ToyyibPay, FPX, approved e-wallets), messaging (WhatsApp Business), maps, analytics, identity verification, calendar feeds, and similar functions.
- Those services are operated by their respective providers under their own terms, privacy notices, and service levels. Amboi.my is not responsible for the performance, security, pricing, or content of any third-party service.
- Links to external websites or social media profiles are provided as a convenience. We do not endorse those sites and are not responsible for their content or practices.
- Payments made outside of the Platform's approved providers are not protected by our escrow, dispute resolution, or refund policies. We strongly discourage off-Platform payments.
8. Tax, Currency, and Financial Information
- Amounts shown on listings are typically in Malaysian Ringgit (MYR). Other currencies, where displayed, are indicative conversions and are not the contract currency.
- Vendors are responsible for charging, collecting, and remitting all applicable taxes (including SST) on the services they sell, and for issuing tax invoices where required by law.
- Customers are responsible for any taxes, duties, or withholdings on their side of the transaction.
- Amboi.my does not provide tax, accounting, legal, financial, investment, or insurance advice. Articles, blog posts, help centre entries, and AI-generated suggestions on the Platform are for general information only — consult a qualified professional before relying on them for a specific decision.
9. AI-Generated Content and Smart Suggestions
- Parts of the Platform use AI to suggest listing titles, descriptions, budget allocations, vendor matches, or planner tips. AI output is provisional and may contain errors or omissions.
- You are responsible for reviewing, editing, and verifying any AI-generated suggestion before relying on it commercially or contractually.
- Where AI suggests Halal, dietary, accessibility, safety, or legal information, treat it as a starting point only — verify with the Vendor and, where appropriate, a qualified professional.
10. Service Availability, Force Majeure, and Cancellations
- The Platform and its features may be modified, suspended, or discontinued at any time. We will give reasonable notice where a change materially affects an existing booking or paid subscription.
- Vendor-side availability — including event-day attendance, delivery windows, and staff allocation — is the Vendor's responsibility. The Platform displays availability and lead-time data as published by the Vendor but does not guarantee it.
- Neither party is liable for failure or delay caused by events outside reasonable control, including natural disasters, infectious disease outbreaks, acts of government, civil unrest, electrical or internet outages, or restrictions on assembly. Such events are governed by the force-majeure clause of the Terms & Conditions.
11. Intellectual Property Notices
- All Platform marks ("Amboi.my", the lime green wordmark, the brand palette), the underlying software, and original Platform content are the intellectual property of Amboi.my and its licensors.
- Vendor logos, listing photos, and other Vendor-supplied content remain owned by the respective Vendors. Customer-uploaded content (avatars, banners, event photos) remains owned by the respective Customers.
- If you believe content on the Platform infringes your intellectual property rights, send a takedown notice to contact@amboi.my with sufficient detail for us to identify and act on the report.
12. Limitation of Liability — Summary
Subject to applicable Malaysian law, and without prejudice to the more detailed limitation in §11 of our Terms & Conditions:
- Amboi.my is not liable for the acts, omissions, conduct, or solvency of any Vendor or Customer.
- Our aggregate liability for any claim is limited to the Platform commission we received on the booking giving rise to the claim, or RM 500, whichever is greater.
- We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, goodwill, or expected savings.
- Nothing in this Disclaimer excludes or limits liability for fraud, gross negligence, or any liability that cannot be excluded under Malaysian law (including the Consumer Protection Act 1999).
13. Indemnification
You agree to defend, indemnify, and hold harmless Amboi.my, its affiliates, directors, officers, employees, and agents from any claims, demands, losses, damages, costs, or expenses (including reasonable legal fees) arising from: (i) your breach of this Disclaimer or the Terms & Conditions; (ii) your misuse of the Platform; (iii) content you submit; (iv) your infringement of any third-party right; or (v) any tax, regulatory, or licensing obligation that is properly yours.
14. Governing Law and Jurisdiction
This Disclaimer is governed by the laws of Malaysia. The parties agree to use the Platform's dispute-resolution process before seeking external recourse. Where required, disputes will be resolved in the courts of Malaysia, except where the Tribunal for Consumer Claims has jurisdiction.
15. Updates to this Disclaimer
We may update this Disclaimer from time to time. Material changes will be communicated by email and via an in-platform notice. The "version" and "last updated" labels at the top of this document tell you which revision is in force. Continued use of the Platform after the effective date constitutes acceptance.
